Terms and Conditions of Sale

Article 1 — Definitions

In these Terms and Conditions of Sale, the following terms have the meanings indicated below:

  • Company: K Horizons OÜ, a limited liability company under Estonian law (OÜ — Osaühing), registered with the Tartu Commercial Register (Estonia) under number 16954138, French SIRET 933 066 631 00013.
  • Website: the website www.kitimimi.com and its associated extensions.
  • Product(s): the goods offered for sale on the Website (personalized "Kitibook" books, cubes, alphabet kits, laces, educational boards, etc.).
  • Order: any purchase order placed by a User via the Website.
  • Pre-order: any order for a Product whose availability date is later than the order date.
  • User / Customer: any natural person browsing the Website or making a purchase for personal (non-professional) purposes.
  • Terms: these Terms and Conditions of Sale governing all orders placed on the Website.

Article 2 — Purpose and Scope

These Terms define the rights and obligations of the parties in the context of the online sale of Products offered by the Company on the Website. Any order placed on the Website implies the Customer's unreserved acceptance of these Terms.

The Company reserves the right to modify these Terms at any time. The applicable version is the one in effect on the date the order is placed.

Article 3 — Products and Prices

The Products offered for sale are described on the Website with the greatest possible accuracy. Product photographs are for illustration purposes only and are not contractually binding.

Prices are displayed in the currency corresponding to the User's market (EUR for Europe, CHF for Switzerland, GBP for the United Kingdom, USD for the United States). They include VAT where applicable.

The Company reserves the right to modify its prices at any time. Products are invoiced on the basis of the prices in effect at the time the order is placed.

Article 4 — Ordering

The Customer places an order on the Website by following the steps of the ordering process: product selection, customization, shopping cart, delivery and payment information, order confirmation.

The order confirmation email constitutes acceptance of the order by the Company. Any order placed on the Website constitutes the formation of a contract concluded remotely between the Customer and the Company.

Article 5 — Payment

Payment is made at the time of order. The accepted payment methods are: credit card (via Stripe), PayPal, and bank transfer.

For bank transfers, the order is processed upon receipt of payment. The Customer must include the order number in the transfer reference.

In case of non-payment or payment incident, the Company reserves the right to suspend or cancel the order.

Article 6 — Delivery

Delivery times are indicated on the Website and vary according to destination. They are given for information purposes and are not contractually binding. The Company endeavors to respect the announced times.

Orders are prepared within 48 business hours (Monday to Friday). Standard delivery times are 2 to 5 business days for Europe.

Delivery is made to the address indicated by the Customer when ordering. In case of absence, the carrier may leave the package at a pickup point.

Free delivery is offered within the European Union for all orders.

Article 7 — Right of Withdrawal

In accordance with European legislation, the Customer has a period of 14 calendar days from receipt of the Products to exercise their right of withdrawal, without having to justify a reason or pay penalties.

Products must be returned in their original condition and packaging. Return shipping costs are the responsibility of the Customer.

The refund is made within 14 days of the Company receiving the returned Products, using the same payment method used for the initial transaction.

Personalized products (with embroidered first name) are excluded from the right of withdrawal.

Article 8 — Warranties

All Products benefit from the legal warranty of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).

The Company is committed to offering quality products. In case of a manufacturing defect, the Customer may contact customer service for a replacement or refund.

Article 9 — Liability

The Company cannot be held liable for damages resulting from misuse of the Products. Products are intended for children and must be used under adult supervision.

The Company cannot be held liable for the non-performance of the contract in case of force majeure (natural disaster, strike, IT failure, etc.).

Article 10 — Personal Data

Personal data collected during the ordering process is processed in accordance with our Privacy Policy, accessible on the Website. The Customer has rights of access, rectification, deletion and opposition in accordance with the GDPR.

Article 11 — Intellectual Property

All elements of the Website (texts, images, logos, illustrations, designs) are the exclusive property of the Company and are protected by intellectual property laws. Any reproduction, even partial, is prohibited without prior written authorization.

Article 12 — Applicable Law and Disputes

These Terms are governed by French law. In case of a dispute, the parties agree to seek an amicable solution before any legal action. Failing that, the competent courts shall be those of Toulouse, France.
